A Proactive Strategy Goes a Long Way

There is no question that due diligence is an important part of any criminal case. When it comes to defending from criminal charges, it is essential to have an understanding of the facts of the case and how best to defend yourself. Our client was in a hotly contested divorce.  The animosity led to accusations of assault – domestic violence. Our client was eventually arrested and charged with assault-domestic violence. Like most people up against serious charges, our client was fearful. He feared being convicted and sent to jail. He was terrified of the prospect of losing his freedom. And, like most, he thought a trial would be risky, despite knowing of his own innocence.

Fortunately, our team was able to review the evidence and develop a strategic defense. During the discovery stage, we reviewed the evidence collected by the prosecution. We also conducted our own investigation, during which we found conclusive evidence that the prosecution’s claims were false. We spent the next weeks developing a proactive strategy to attack the prosecution’s case, establishing that their evidence was all but conclusive and that our client was indeed innocent. 

Upon reviewing the evidence collected in our investigation, the state agreed to dismiss the charges. Our client was able to get both the arrest and charges expunged from his record, freeing him from the burden that comes with serious charges on one’s record. Finally, he was able to get back to his normal life after being falsely accused of these crimes.

This case is a perfect example of how due diligence can go a long way. If we had not spent the time to investigate, if we had approached this case differently, our client may have been convicted and faced jail time, all because he was accused of a crime he didn’t commit. Due diligence can result in an outright dismissal, as in this case, if we’re able to establish that the prosecution’s evidence is faulty.
